Devine Sealcoating (\"we,\" \"us,\" \"our,\" or \"Service Provider\") provides asphalt maintenance services, including sealcoating, crack filling, patching, striping, and related work (the \"Services\"). These terms and conditions govern your use of our website www.devinesealcoating.com and any Services you request or contract for.

These Terms & Conditions apply to all Services, quotes, contracts, and agreements provided by Devine Sealcoating. By accessing our website, requesting a quote, accepting a quote/contract, scheduling work, or enrolling in any program (including Devine Protection), you agree to be bound by these terms. We reserve the right to update these terms at any time, with changes effective upon posting to our website or notification.

Section 1

Services, Quotes & Contracts

All quotes are valid for [15 days] unless otherwise stated in writing.
Acceptance of quote (by signature, deposit, or proceeding with scheduling) creates a binding contract incorporating all terms herein.
Prices are based on site conditions at the time of quote. We reserve the right to adjust prices if conditions change.
Services will be performed in a professional manner using industry-standard materials and methods.
We use [Jennite AE] from Neyra an asphalt-based emulsion with additives meeting relevant specifications.
We will provide all the tools, equipment, and materials needed unless the client and us agree otherwise.
If unforeseen materials are needed, we will inform the client, who may approve or deny additional purchases.

Section 2

Invoice & Payment

Upon completion of the work, an invoice will be sent via email and/or text.
Balance is due in full upon completion for standard sealcoating and maintenance jobs, unless other terms are mutually agreed upon in writing beforehand.
Please remit payment in the full amount shown as due on invoice by the due date listed on invoice.
Payment Methods: Cash, check, debit card, credit card (Visa, Mastercard, Am-Ex, Discover) , ACH/bank transfer, Apple/Google/Samsung Pay, or Venmo/Cash App. Pay securely through our client hub, call our office to process payment over the phone, or pay on-site at the time of service. Make checks payable to Devine Sealcoating. Mail checks to P.O. Box 24340 Rochester NY 14624.\n
Deposit: For larger projects, a [20% deposit] may be required upon acceptance of the quote to secure materials and scheduling, with the balance due upon completion.
Deposits can be made through payment methods listed above.
Late payments may incur a late fee of [2% per month] (or the maximum allowed by law, whichever is lower) on any unpaid balance after [10 days], plus any applicable collection costs.
Unpaid balances may result in collections action and/or a mechanic's lien placed on the property in accordance with applicable state laws.
Sales Tax: Client is responsible for the transaction's applicable federal, state, and local taxes. No tax exemptions will be recognized unless a valid tax exemption certificate is provided.

Section 3

Cancellations & Changes

Jobs may be rescheduled at no charge with reasonable notice.
Cancellations: Once a job has been scheduled and we have sent the [24–48] hour courtesy reminder, cancellations (without rescheduling to a new mutually agreeable date) may incur a cancellation fee (up to [20% of quote] or [$75 trip charge], whichever is greater). This fee covers lost scheduling opportunities, preparation time, and potential last-minute materials or routing adjustments. Cancellations outside this window or for rescheduling purposes are not subject to this fee.
No-Shows: If the site is not accessible on the scheduled date, a [$75 trip charge] (or [20% of quote], whichever is greater) may apply, and the job may be rescheduled.
Changes to Scope: Any changes to the agreed scope of work must be made in writing (email or text is acceptable) and may result in adjustments to pricing and/or timeline.
Any additional work requested that's not listed in the quoted scope of work specifications will be billed at an agreed upon rate at the time of such request.

Section 4

🛡️Devine Protection Loyalty Program

Devine Sealcoating offers the Devine Protection Loyalty Program (the \"Program\") as a free, optional benefit to reward valued customers with exclusive discounts, automatic annual sealcoating quotes, priority scheduling, referral rewards, and other perks.

Participation in the Program is voluntary and governed by separate Devine Protection Loyalty Program Terms and Conditions, available at →

By enrolling in the Program (for example, by providing consent on a service request form, during a service appointment, via our website, or over the phone), you agree to be bound by those separate terms. Enrollment requires consent to receive recurring email and/or SMS communications for Program benefits, but no purchase is required to join or remain a member.

All discounts, promotions, and benefits associated with the Program are exclusive to enrolled members and are not available to non-members.

Devine Sealcoating reserves the right to modify or discontinue the Program in accordance with its separate terms.

Section 5

Scheduling & Weather

Upon approval of the quote and receipt of any required deposit, we will schedule your job for a mutually convenient date and time.
We will send a courtesy reminder [24-48 hours] in advance via email, text, or phone, during which we ask that you move vehicles, clear the driveway, and ensure the work area is fully accessible for safe and efficient service.
Exact arrival times may vary due to weather, traffic, or previous job durations, but we will notify you promptly of any significant changes or necessary rescheduling.
Service is weather-dependent (typically requires dry conditions and temperatures above 50°F/10°C).
In the event of inclement weather that prevents safe or effective performance, we will reschedule at the earliest mutually convenient time with no additional fees
No liability for delays due to weather, acts of God, or factors beyond our control.

Section 6

Customer Responsibilities

Provide clear access to the work area (remove vehicles, obstacles, etc.).
Ensure the surface is suitable for sealcoating or other services (e.g., no major structural issues; sealcoating is maintenance, not repair for severe damage).
Notify us of underground utilities, sprinklers, or hidden features.
Keep pets, children, and vehicles off the treated area for at least 48-72 hours or until dry.

Section 7

Warranties & Limitations

Sealcoating: Limited warranty on materials and application for [60 days] from completion. Covers peeling/flaking due to our workmanship only.
No sealcoating after [October 1] carries a full warranty due to cold weather risks (e.g., roller marks).

*This warranty does NOT cover:

Existing cracks reappearing (sealcoating does not fill or prevent cracks structurally).
Damage from oil/gas spills, chemicals, tree sap, heavy equipment, snow plows, tire marks, or power steering.
Failure due to poor drainage, sub-base issues, or pre-existing conditions.
Residues (e.g., oil, detergents) that prevent adhesion.
Normal wear, UV fading, or oxidation.
Crack filling/patching: Limited to [6 months].
We are not responsible for damage to adjacent areas (e.g., concrete, landscaping) from normal equipment use.
All warranties void if payment is not made in full or if unauthorized work is done on the surface.
Sealcoating extends asphalt life but is not a permanent fix or \"new asphalt.\" It protects against UV rays, water, and oxidation but does not repair underlying damage.

Section 8

Liability & Indemnity

Our total liability is limited to the cost of the Services provided.
We are not liable for indirect, consequential, or incidental damages.
You agree to indemnify us against claims arising from pre-existing site conditions or your failure to follow instructions.
Heavy equipment may cause minor damage to soft surfaces — we take care but are not responsible for normal operational marks.

Section 9

Governing Law

These Terms are governed by the laws of the State of New York.
Any disputes will be resolved in Monroe County courts.

Website Use

Content on our site (photos, descriptions, prices) is for informational purposes only and not guaranteed.
We disclaim all warranties regarding site accuracy or availability.

Section 11

Changes to Terms

We may update these Terms. Continued use of our Site/Services constitutes acceptance.
